Privacy Notice
Effective 21 October 2026
1. Who we are and what this notice covers
SmartGen Service (Thailand) Co., Ltd. (the “Company”, “we” or “us”) is the controller of personal data described in this notice. It covers visitors to smartgenservice.co.th, people making enquiries or requesting quotations, customers, and representatives or site contacts involved in our generator services, custom control panels and SmartGen equipment sales.
The website presents our business and services. It does not provide a contact form, user accounts or online checkout. If you use a telephone or email link, your enquiry takes place through the communication service you choose, rather than through a website form.
2. Information we collect and its sources
- Enquiries and business contacts: your name, organisation, role, telephone number, email address and information you provide when discussing your requirements.
- Quotations and service work: contact and billing details, delivery or work-site addresses, appointment details, equipment information, correspondence and service records, to the extent they relate to an identifiable person.
- Site visits and photographs: relevant site-contact details and images needed to assess or document work. Photographs may contain personal data if people, vehicle registrations or other identifying details are visible.
- Website operation: technical information that may be processed when the website is accessed, such as an IP address, browser information, access time and requested pages, and any saved privacy preferences.
We receive information directly from you and, where needed for the work, from your organisation, an authorised representative or a site coordinator. Please provide only information relevant to your request and avoid sending sensitive personal information or unnecessary identity-document copies. If another person supplies your information, we will provide the applicable notice as required by law.
3. Why we use information and our legal bases
- Responding to enquiries, preparing quotations and arranging requested assessments: taking steps at your request before entering a contract, or our legitimate interest in responding to business enquiries and communicating with representatives of prospective customers.
- Supplying equipment, arranging visits, delivering services and handling after-sales matters: performing a contract with you. For customer employees, representatives and site contacts who are not parties to that contract, we rely on our legitimate interest in coordinating and fulfilling the work.
- Accounting, tax and records required by law: compliance with applicable legal obligations.
- Protecting the website, managing business records and resolving disputes: our legitimate interests in secure operations and establishing, exercising or defending legal claims, balanced against your rights and freedoms.
- Optional external content: your consent where required, separate from the information needed to provide our core services.
We use personal data only as necessary for the stated purposes. If a new use requires additional notice or consent, we will provide it before proceeding. Viewing this notice or using the website does not, by itself, constitute consent.
Information needed to prepare a requested quotation, perform a contract or meet a legal requirement must be provided for that activity. If it is not provided, we may be unable to provide an accurate quotation, arrange access, deliver the requested service or issue the required documents. Optional information and optional external content are not conditions for making an enquiry.
4. Project photographs
Photographs used to assess or record service work are separate from photographs selected for public display. Before publishing project photographs, we will review whether they reveal identifiable people or other personal information, avoid or obscure unnecessary identifying details, and establish an appropriate legal basis, obtaining consent where required. Providing a photograph for service work does not automatically authorise its publication.
5. Website entry choices and external maps
Before entering the website, you are informed about Google Maps and can choose to accept and enter, or decline and leave. The map loads only after you choose to accept. Taking no action or reading this notice does not constitute acceptance. This privacy notice remains available before you make your choice.
Loading the map may send information such as your IP address and browser details to Google, which may use cookies or similar technologies under its own policies. We store your choice to remember your decision. To reset your choice, clear this website’s stored data in your browser, then reload or reopen the website. The entry choices will appear again, and the map will not load unless you accept again. This does not undo information already received by Google or clear data stored separately by Google. You can contact the Company using the details below to exercise your rights.
An outbound Google Maps link takes you to an external service at your own choice. Acceptance to enter the website does not waive your statutory rights, and you can still contact the Company using the details in this notice.
6. Who may receive information
Access is limited to people who need the information for the stated purposes. Where necessary, recipients may include authorised staff; technicians, installation or delivery partners involved in your work; providers supporting our website, communications or record keeping; professional advisers; and public authorities where disclosure is required or permitted by law. Only relevant information will be shared. These categories do not mean every recipient receives every customer’s information.
7. Processing outside Thailand
Depending on the providers and optional services used, information may be processed outside Thailand. Before arranging a transfer that is subject to Thai personal data protection law, we will assess the applicable requirements and establish a lawful transfer basis or required protection measures. We do not assume that every destination offers equivalent protection. You may contact us for information about any overseas processing relevant to your data.
8. How long we keep information and how we protect it
We retain information for as long as necessary for its purpose, taking account of the status of the enquiry or contract, ongoing service and warranty responsibilities, applicable accounting and tax requirements, and any relevant dispute or legal-claim period. We review information when those needs end and delete, destroy or anonymise it when there is no continuing lawful reason to retain it. A specific period can be explained for the relevant type of record on request.
We will apply appropriate organisational and technical measures in proportion to the nature of the information and the risks, including limiting access to those who need it. No transmission or storage method can be guaranteed completely secure.
9. Your rights
Subject to the conditions and exceptions under applicable law, you may request access to and a copy of your personal data, information about its source where obtained without consent, correction, erasure or anonymisation, restriction of use, and transfer of data where the portability right applies. You may also object to processing on applicable grounds.
Where processing is based on consent, you may withdraw it at any time. Withdrawal does not affect the lawfulness of earlier processing. We will explain any consequences of withdrawal; declining website entry does not affect your statutory rights, and you may contact us using the details in this notice.
Contact us using the details below to exercise your rights. We may request information reasonably necessary to verify your identity and understand the request, and will respond within the applicable legal timeframe. If a request cannot be fulfilled, we will explain the applicable reason. You may complain to the competent expert committee through the Office of the Personal Data Protection Committee if you believe your rights under Thai personal data protection law have been infringed; contacting us first is not a condition of that right.
